Rush Memorial Hospital has been dismissed from the wrongful death suit filed in Marion County Superior Court by Robb and Robb and the Tabor Law Firm, representing the estate of Sandra Pearson, R.N. Pearson was a flight nurse, who along with the pilot and the flight paramedic, were killed when a Bell helicopter used by Air Evac suffered a failure of the main rotor blade, causing the helicopter to crash in a Decatur County field in August, 2008. Pearson’s estate agreed that all other claims in this lawsuit against all defendants would be dismissed for payment of $5.6 million by Bell Helicopter. Rush Memorial Hospital CEO Brad Smith said that the law suit filed by Robb and Robb and the Tabor Law firm was a classic example of naming any and all parties, regardless of involvement or liability. "The relationship with Air Evac from the beginning has been very clear," Smith said. "The company leases land from the hospital. The hospital does not own, dispatch nor mange any aspect of Air Evac. Rush Memorial regrets the tragedy and does not believe that anyone could have done anything to avoid the accident. Air Evac exhibits the highest levels of safety for its employees and patients served by this beneficial service. Our thoughts and prayers continue to go out to the families that experienced a loss that day." Rush Memorial was represented by the hospital’s corporate counsel in this matter and was fortunate not to incur defense fees or any other costs associated with the suit, Smith said.x_News
